State Administrative Rules
The North Dakota Legislative Council publishes the North Dakota Administrative Code (the codification of rules adopted by state administrative agencies). In addition to the Administrative Code available on this site, individual state agencies may have portions of their rules on their web pages.
The North Dakota Legislative Council compiles notices of administrative agency proposed rulemaking. Under North Dakota Century Code Section 28-32-02, a state administrative agency must file a notice of proposed rulemaking with the Legislative Council, must publish an abbreviated notice in each official county newspaper in the state, and must mail a copy of the full notice to each person who has requested a copy of the notice. The full notice must contain a short explanation of the proposed rule, a determination whether the proposed rule will have an impact in excess of $50,000 on the regulated community, identify at least one location where interested persons may review the text of the proposed rule, provide an address to which comments concerning the proposed rule may be sent, provide a phone number at which a copy of the rule and the regulatory analysis may be requested, and provide a time and place set for oral hearing on the proposed rule. The Legislative Council provides a subscription service, which provides a monthly mailing of filed notices to subscribers.
