Senator Ray Holmberg, Chairman, convened the committee by telephone at 12:00 noon.

Members present: Senators Ray Holmberg, David O'Connell, Terry M. Wanzek; Representatives Ole Aarsvold, Linda Christenson, David Drovdal, Lyle L. Hanson, RaeAnn Kelsch, David Monson, Laurel Thoreson

Members absent: Senators Pete Naaden, Randy A. Schobinger, Vern Thompson, Dan Wogsland; Representatives Thomas T. Brusegaard, Howard Grumbo, John Mahoney, Dennis J. Renner

Chairman Holmberg said the conference call was convened because the committee did not have a quorum at its meeting on October 23, 1998.

It was moved by Representative Hanson, seconded by Senator O'Connell, and carried on a voice vote that the minutes of the September 17-18, 1998, meeting be approved as distributed.

It was moved by Representative Kelsch, seconded by Representative Aarsvold, and carried on a roll call vote that the bill draft to create and enact a new title to the North Dakota Century Code relating to elementary and secondary education be approved, as amended, and recommended to the Legislative Council. Senators Holmberg and Wanzek and Representatives Aarsvold, Christenson, Drovdal, Hanson, Kelsch, Monson, and Thoreson voted "aye." Senator O'Connell voted "nay."

It was moved by Senator O'Connell, seconded by Representative Aarsvold, and carried on a roll call vote that the bill draft to reconcile cross-references to Title 15 be approved, as amended, and recommended to the Legislative Council. Senators Holmberg, O'Connell, and Wanzek and Representatives Aarsvold, Christenson, Drovdal, Hanson, Kelsch, Monson, and Thoreson voted "aye." No negative votes were cast.

It was moved by Representative Kelsch, seconded by Representative Christenson, and carried on a roll call vote that Sections 15-21-06, 15-21-07.2, 15-21-09.1, 15-21-13, 15-21-19, 15-21.1-01, 15-21.1-02, Chapter 15-21.2, Sections 15-22-12, 15-22-25, 15-27.1-02, 15-27.1-08, 15-27.1-09, 15-27.3-06, 15-27.3-07, Chapters 15-27.6 and 15-27.7, Section 15-29-03.1, subsection 27 of Section 15-29-08, and Sections 15-38-06, 15-38-13, 15-41-01, 15-41-03, 15-41-04, 15-41-05, 15-41-07, 15-41-08, 15-43-11.1, 15-47-10, 15-47-12, 15-47-16, 15-47-24, 15-47-29, 15-47-30, 15-47-31, 15-47-32, 15-47-37, 15-47-40, 15-47-41, 15-49-03, 15-49-04, 15-49-05, 15-49-06, 15-51-03, 15-51-05, 15-51-06, 15-51-08, 15-51-09, 15-51-10, 15-51-14, 15-51-15, 15-51-16, 15-51-18, 15-51-19, 15-51-22, and 15-65-01 of the North Dakota Century Code are repealed by omission. Senators Holmberg and Wanzek and Representatives Aarsvold, Christenson, Drovdal, Hanson, Kelsch, Monson, and Thoreson voted "aye." Senator O'Connell voted "nay."

It was moved by Senator O'Connell, seconded by Representative Drovdal, and carried on a roll call vote that the concurrent resolution directing the Legislative Council to continue its study of those provisions of Title 15 which relate to elementary and secondary education be approved and recommended to the Legislative Council. Senators Holmberg, O'Connell, and Wanzek and Representatives Aarsvold, Christenson, Drovdal, Hanson, Kelsch, Monson, and Thoreson voted "aye." No negative votes were cast.

It was moved by Senator O'Connell, seconded by Senator Wanzek, and carried on a roll call vote that the chairman and the staff of the Legislative Council be requested to prepare a report and the bill and resolution drafts recommended by the committee and to present the report and recommended bill and resolution drafts to the Legislative Council. Senators Holmberg, O'Connell, and Wanzek and Representatives Aarsvold, Christenson, Drovdal, Hanson, Kelsch, Monson, and Thoreson voted "aye." No negative votes were cast.

It was moved by Representative Aarsvold, seconded by Representative Kelsch, and carried on a voice vote that the meeting be adjourned sine die.
