1 Payments for limited
English proficient students - The 1997 Legislative Assembly provided that up to
$300,000 of the amount appropriated for foundation aid must be used by the
Department of Public Instruction to provide payments to school districts for
educating students with limited English proficiency, pursuant to North Dakota
Century Code Section 15-40.1-07.7. This amount is not a separate appropriation
and is included in the per student payment amounts shown on Appendix A.

3 Technology reimbursement payments - Section 6 of 1997 House
Bill No. 1013 provides that districts are eligible to receive reimbursement for
technology-related expenditures incurred during the three-year period of July
1, 1996, to June 30, 1999. Districts are eligible to receive up to their
proportionate share of the $5 million appropriation, based on student ADM. More
than 50 percent of the biennial appropriation was spent during the first year
of the biennium because districts documented enough technology-related
expenditures incurred during the 24-month period of July 1, 1996, to June 30,
1998, to receive 88 percent of the amount appropriated.
4 Payments for limited English proficient students - North Dakota
Century Code Section 15-40.1-07.7 provides that the department must distribute
to school districts by May 30 of each year payments of $300 for each student
identified as limited English proficient. The department originally estimated
that 450 to 500 students would be classified as limited English proficient. For
1997-98, school districts requested reimbursement for 398 students. The
department anticipates that enough limited English proficient students will be
identified for 1998-99 to allow for the distribution of the entire
appropriation.
5 State tuition fund distributions - Allocations from the state
tuition fund, which are dependent upon the collection of fines from the
violation of state laws and interest income from the state common schools trust
fund, have been higher than anticipated. The appropriation assumed allocations
of $204 per census unit. However, tuition fund payments for 1997-98 were $216
per census unit, the same amount estimated for the second year of the
biennium.
